&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;Since 2009, the maximum FHA loan limit for Clak County has been $400,000.&amp;nbsp; If there are not actions taken by Congress, on October 1st the new maximum loan limit will DECLINE to $287,500.&amp;nbsp; To remain at a 3.5 perent down payment, the maximum sales pice would have to be $298,000.&amp;nbsp; Any higher sales price and the down payment will rise dollar for dollar to keep the maximum loan at $287,500.&lt;/div&gt;

&lt;div&gt;This may seem like a small issue because Las Vegas area prices ae so low.&amp;nbsp; However, it is very challenging to get HUD to raise the FHA limits.&amp;nbsp; FHA loans are a huge part of our of our market.&amp;nbsp; &lt;/div&gt;

FORECLOSURES AND SHORTSALES&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/div&gt;
&lt;p&gt;SB414&amp;nbsp;- With the Governor for signature&lt;/p&gt;
&lt;p&gt;Makes it a &lt;strong&gt;misdemeanor for a bank to unreasonably delay responding to a short sale&lt;/strong&gt; offer.&amp;nbsp;It spells out the acceptance or rejection of an offer should be received within 90 days.&amp;nbsp;It also prohibits a bank from getting a deficiency judgment if they agreed to a short sale (under certain circumstances).&amp;nbsp;&lt;/p&gt;
&lt;p&gt;AB273&amp;nbsp;- &amp;nbsp;With the Governor for signature&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Prevents the bank from "double-dipping"&lt;/strong&gt; and going after the borrower for the full amount of the deficiency when they have received compensation from other sources.&amp;nbsp;It will cap the amount a third party can be awarded if they bought the right to the deficiency for pennies on the dollar.&amp;nbsp;It will reduce the amount of time a junior lien holder has to file for a deficiency form the current six years to six months, to be in line with primary lien holders&amp;#239; timeframes.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;SB136&amp;nbsp; - &amp;nbsp;Expected to be delivered to the Governor shortly.&lt;/p&gt;
&lt;p&gt;Changes the maximum length of time a state-chartered &lt;strong&gt;bank may hold real property that they acquired through foreclosure from 10 years to 5 years.&lt;/strong&gt;&amp;nbsp;Also removes the requirement that a bank annually charge off a certain percentage of the value of such real property.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;u&gt;REAL ESTATE SERVICES TAX&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;AB569&amp;nbsp;- Did not pass&lt;/p&gt;
&lt;p&gt;Would have required &lt;strong&gt;Real Estate commissions be taxed at 1%.&lt;/strong&gt;&amp;nbsp;The tax would have been paid by the consumer based on the purchase price of the services and would have taken effect on January 1, 2012.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;u&gt;ENERGY AUDIT FORM OR WAIVER&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;This bill requires Energy auditors to be licensed by the Real Estate Division.&amp;nbsp;Most importantly this bill &lt;strong&gt;repeals the section of NRS that mandates the seller to provide an evaluation of energy consumption of that property&lt;/strong&gt;.&amp;nbsp;Effective July 1, 2011.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;u&gt;CELL PHONE USE WHILE DRIVING&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;SB140&amp;nbsp; - &amp;nbsp;With the Governor for signature&lt;/p&gt;
&lt;p&gt;Prohibits the use of a cellular telephone or other handheld wireless communications device while operating a motor vehicle in certain circumstances. &lt;strong&gt;&amp;nbsp;Prohibits the use of cell phone without a hands-free device while driving.&lt;/strong&gt;&amp;nbsp;Prohibits typing/reading data texting, e-mail, IM, web browsing, etc.&amp;nbsp;Violation is a misdemeanor with fines increasing with each offense and possible license suspension.&amp;nbsp;July 1, 2011&amp;nbsp;- December 31, 2011, violators will receive a warning.&amp;nbsp;Beginning January 1, 2012 violators will receive a citation.&amp;nbsp;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;u&gt;PROPERTY MANAGEMENT ISSUES&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;AB360&amp;nbsp;- Should be delivered to the Governor for signature shortly.&lt;/p&gt;
&lt;p&gt;Mandates that local governments pass an ordinance to afford property owners at least &lt;strong&gt;30 days to fix a nuisance or dangerous/noxious situation &lt;/strong&gt;that was caused by the criminal activity or someone other than the owner, as long as the situation is not an immediate danger to public health, safety or welfare.&amp;nbsp;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;AB226&amp;nbsp;- Is law and goes into effect October 1, 2011.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Adds functioning door lock as part of the definition of essential items&lt;/strong&gt; and services.&amp;nbsp;It also requires a notification to the tenant that a lockout will happen within 24 hours of the sheriff receiving the order from the court.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;u&gt;PRIVATE TRANSFER FEES&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;AB271 -&amp;nbsp;Law effective May 20, 2011&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Regulates private transfer fee obligations that affect real property&lt;/strong&gt;.&amp;nbsp;A Private Transfer Fee is attached to a property as a covenant that requires the payment (typically 1&amp;nbsp;- 2% of the purchase price) to a private entity every time the property changes hands up to 99 years.&amp;nbsp;&lt;/p&gt;

&lt;div&gt;&lt;strong&gt;Requires the registration, permitting, and regulation of asset management companies and their employees and agents through the Real Estate Division&lt;/strong&gt;.&amp;nbsp;In addition there is also a provision that removes the ability for the purchaser to waive the SRPD, and spells out that a &lt;strong&gt;seller may not require a purchaser to waive the SRPD&lt;/strong&gt;.&amp;nbsp;It also adds that is an asset manager knows of any defects in the property, &lt;strong&gt;he must give written notice of the defect to the purchaser&amp;nbsp;

&lt;p&gt;Vegas Inc. magazine is the presenter of the Best Places to Work. This annual award was conceived in order to identify Southern Nevada’s best workplaces. Vegas Inc readers were asked to nominate local companies. &lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;I studied voice at Oklahoma State University and University of Montana as well as piano.&amp;nbsp; I grew up in a family that loves music and is very talented.&amp;nbsp; My Father plays guitar and piano by ear.&amp;nbsp; He can't read a lick of music but can play and sing beautifully.&amp;nbsp; Over the years he has played in country bands and entertained at family events.&amp;nbsp; My sister is also an extremely talented singer.&amp;nbsp; I have performed over the years in choirs, churches, weddings, funerals, events, musical plays, fashion shows, talent contests&amp;nbsp;and of course karaoke.&amp;nbsp; &lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;My husband talked me into auditioning....well it really wasn't that hard to "talk me into it."&amp;nbsp; Green Valley Ranch Stations Casino and Channel Five hosted the pre-event tryouts at the Green Valley Ranch Casino conference center Friday, May 6th.&amp;nbsp; The format was as follows:&amp;nbsp;&amp;nbsp; &lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;*&amp;nbsp; The first 250 qualified individuals and groups would be eligible to audition.&lt;/div&gt;
&lt;div&gt;*&amp;nbsp; The sponsors (Green Valley Ranch Stations Casino and Channel 5) would send the top three acts to Dallas, Texas May 26th to audition in front of Simon Cowell and the other judges.&lt;/div&gt;
&lt;div&gt;*&amp;nbsp; The lucky winners receive a front of the line pass in Dallas.&amp;nbsp; In other words the lucky winners do not have to wait in the stadium for hours and days with other hopefuls.&lt;/div&gt;
&lt;div&gt;*&amp;nbsp; The participants could get in line at 5:00 a.m. on Friday morning...but not before.&amp;nbsp; Camping out was not allowed.&lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;I arrived at the line at 5:10 a.m.&amp;nbsp; Wow!&amp;nbsp; I was absolutely blown away.&amp;nbsp; I started walking down the line to find the end and it seemed to go on and on!&amp;nbsp; I got in line and began my wait.&amp;nbsp; Fortunately, my husband was kind enough to bring me a cup of&amp;nbsp;coffee around 5:30 a.m.&amp;nbsp; Keep in mind, I had to get up about 3:30 a.m. to prepare for my audition.&amp;nbsp; This included getting "decked out" in my&amp;nbsp;audition outfit, makeup and hair style.&amp;nbsp; &lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;Registration began about 7:45 a.m.&amp;nbsp; I was registered at 8:45 a.m.and ready to wait for my audition.&amp;nbsp; By the way...I was number 216!&amp;nbsp; Remember, only 250 qualified auditions would be allowed.&amp;nbsp; I was in line at 5:10 a.m. and barely made the cut to audition.&lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;We were all asked to wait in banquet rooms&amp;nbsp;until our time to audition.&amp;nbsp; Five numbers were called at a time to stand outside the audition room.&amp;nbsp; While I waited in the holding rooms, I watched and listened to some very talented singers and groups!&amp;nbsp; What an experience listening to singers vocalizing, practicing their songs and performing for the waiting singers.&amp;nbsp; It was loud and the energy was through the roof.&lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;I had decided to sing Faith Hill's - "It Matters to Me."&amp;nbsp; I like the song because I can sing it easily&amp;nbsp;a cappella (without&amp;nbsp; accompaniment.).&amp;nbsp; I had practiced for a couple of weeks before the event and really felt I was ready!&amp;nbsp; &lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;By the time I was called to audition it was nearly 2:00 p.m.&amp;nbsp;&amp;nbsp; I was really nervous!&amp;nbsp; Sitting around waiting to audition is a stressful situation.&amp;nbsp; We were each given the following instructions:&amp;nbsp; 1)&amp;nbsp; We would have 2 minutes from the second we walked into the audition room to when we walked out.&amp;nbsp; The most amount of singing you could do would be 90 seconds.&amp;nbsp; 2)&amp;nbsp; We were instructed to Give our name, our audition number, song we were going to sing and our &lt;strong&gt;&lt;em&gt;age&lt;/em&gt;&lt;/strong&gt;!&amp;nbsp; Yeah...that's right...our age.&amp;nbsp; I was not happy about that part.&lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;I walked into a huge Red X FACTOR wall that was light brightly with professional lights.&amp;nbsp; There were two or three cameras and a table of six judges.&amp;nbsp; The judges included a producer from X Factor, a former contestant from American Idol and the balance was local credentialed judges.&amp;nbsp; Very intimidating.&amp;nbsp; I said my list of required statements, and started singing....&amp;nbsp;&amp;nbsp; wow!&amp;nbsp; I felt I did well and the judges told me I did a great job.&amp;nbsp; So, I waited for my call back....&lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;Friday evening the final 20 were to be called back for an additional audition Saturday morning at 10:00 a.m. at Channel 5.&amp;nbsp; I waited...finally at about 9:00 p.m. I received a call from a long distant phone number that I didn't recognize.&amp;nbsp; I was actually in the movie but I picked it up because it might be the call!&amp;nbsp; It was my long time friend Lisa Hungate who had moved to New Orleans.&amp;nbsp; She was checking in to see how it went!&amp;nbsp; &lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;During the entire time I was in line and waiting to audition, I kept all of my fiends up to speed via Facebook and texting.&amp;nbsp;&amp;nbsp; What I had hoped to get out of my experience auditioning for X Factor was an opportunity to go to the auditions in Dallas with a front of the line pass.&amp;nbsp; What I actually got out of the experience was amazing interest and support from my friends, clients and fellow Real Estate agents.&amp;nbsp; What a blast!&amp;nbsp; My recommendation to each of you is to go for it!&amp;nbsp; Nothing Ventured, nothing gained!&lt;/div&gt;

&lt;div&gt;It is likely we have at least another two years of distressed property sales coming in the Las Vegas market.&amp;nbsp; Currently 16% of homeowners are more than 60 days delinquent on their mortgage payment and 75% are underwater.&amp;nbsp; Prices are likely to remain suppressed for the foreseeable future.&lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;With so many homes underwater and so many homeowners delinquent, why aren't banks foreclosing more quickly.&amp;nbsp; Banks seem reluctant to foreclose on homes expeditiously, and many people are still living in their homes months even a year or more after they stopped making their payments.&amp;nbsp; Banks sense the very precarious nature of the housing crisis.&amp;nbsp; They realize that aggressively proceeding with foreclosing as their first remedy would be self defeating, driving prices down both lower and faster.&amp;nbsp; That is the reasoning underlying the short sale.&amp;nbsp; Leave the homeowner in the home, let him maintain the home, and help him out of his underwater condition.&lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;With that in mind, why wouldn't the bank "short sale" the home to the homeowner who is living in the property?&amp;nbsp; If anyone has the answer to this let me know!&lt;/div&gt;

Recently, well recently in my world, I was delivered a magnificent opportunity. I underwent two brain surgeries in the last 4 years. &lt;/span&gt;

&lt;span style="font-size: 14pt"&gt;&lt;span style="font-size: 12pt"&gt;&lt;span style="font-size: 10pt"&gt;Oh, I can read your thoughts and it &amp;#239;s ok. It took me awhile to see this painful, irritating, confusing, inconvenient and seemingly endless medical issue as an opportunity. I don't expect you to embrace the concept right away.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/div&gt;
&lt;/div&gt;
&lt;div&gt;&lt;br /&gt;
&lt;span style="font-size: 14pt"&gt;&lt;span style="font-size: 12pt"&gt;&lt;span style="font-size: 10pt"&gt;What I was ultimately taught was;&lt;br /&gt;
TEN TIPS TO TOUGHNESS&lt;br /&gt;
&lt;br /&gt;
1. Ensure that you are always saying encouraging things under pressure.&lt;br /&gt;
&lt;br /&gt;
2. Recall past personal successes, just before and during high pressure situations.&lt;br /&gt;
&lt;br /&gt;
3. Ensure that all thoughts of failure are rejected as soon as they enter your mind.&lt;br /&gt;
&lt;br /&gt;
4. Anticipate what might go wrong before it actually does, and prepare for the eventuality.&lt;br /&gt;
&lt;br /&gt;
5. Get involved in high-pressure situations, do not avoid such situations, relish in being involved at the most pressure-filled points.&lt;br /&gt;
&lt;br /&gt;
6. No matter what distracting or upsetting thing happens when under pressure, remind yourself about your original aim, stay focused on your goal.&lt;br /&gt;
&lt;br /&gt;
7. If something goes wrong, do not interpret this as you being a entirely worthless person.&lt;br /&gt;
&lt;br /&gt;
8. Review past mistakes in pressure situations and improve your skills to overcome your mistakes.&lt;br /&gt;
&lt;br /&gt;
9. Confide in close friends to seek ways to improve your skills, it takes strength to admit weaknesses.&lt;br /&gt;
&lt;br /&gt;
10. Learn to take risks and accept the inevitable failures, as part of the process of&amp;nbsp;training yourself to become mentally tough.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;When we were kids anything was possible and nobody told us “no you can’t.” So, what happened to our dreams? &lt;/p&gt;
&lt;p&gt;&amp;nbsp;Somewhere along the way we stop dreaming and start doing, which is when it all stops. That is when our lives start to lose purpose and when we stop growing. &lt;/p&gt;
&lt;p&gt;&amp;nbsp;Those dreams we had as kids were like a magnet which pulled us to what we wanted in life- they made us excited to go for it every day.&amp;nbsp;Think about the last time you truly thought about what you wanted to be when you grew up? &lt;/p&gt;
&lt;p&gt;&amp;nbsp;Growing into what you want to become does not have to stop. We can breakaway and get off the hamster wheel anytime and start moving forward again like when we were kids. We just have to take time to dream and believe. Break away from the pack, and go for it. Don’t blend in. Be different.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;It is uncomfortable at first when you step outside of your comfort zone and get off the hamster wheel where it was safe. But if you have the courage, there is still a lot more you can accomplish in this life.&lt;/p&gt;

&lt;p&gt;Dear Friends and Colleagues, &lt;/p&gt;
&lt;p&gt;I was asked by a colleague how everything that is going on affects me. After all, the news is flooded with stories regarding the bank initiated foreclosure moratorium, the attorneys general in each of the 50 states launching foreclosure investigations, and today, the Obama administration inserting their opinion regarding the moratorium. Confidently, I replied, "There is no better time to be doing short sales." &lt;/p&gt;
&lt;p&gt;Disclaimer One: In the time taken to write this opinion, something has changed. Disclaimer Two: Not all banks are doing the same thing, so keeping things straight may be confusing. Disclaimer Three: The Obama administration officially became involved as of this morning, see Disclaimer One. &lt;/p&gt;
&lt;p&gt;In short, some banks have suspended foreclosures while they review their procedures and others are proceeding with foreclosures while doing process reviews. For example, Bank of America has suspended foreclosures in all 50 states and has stopped foreclosure sales until their assessment has been completed, while GMAC Mortgage, now a division of Ally Financial, has suspended evictions and foreclosures in the 23 states that call for a judge's approval and is reviewing foreclosure practices in the other states. &lt;/p&gt;
&lt;p&gt;Additionally, PNC Financial Services and Litton Loan Services are reviewing their practices. JPMorgan Chase suspended foreclosures in the 23 judicial approval states and is reviewing its practices in a handful of the other states. Wells Fargo, Citigroup and U.S. Bancorp have not announced a suspension of foreclosures even though they are on the list of banks to be scrutinized by regulators and attorneys general. &lt;/p&gt;
&lt;p&gt;Delays will be costly for banks and taxpayers, because banks and government-owned Freddie Mac and Fannie Mae must continue to pay maintenance and other expenses on foreclosed properties being held in inventory. Time is of the essence. According to Radar Logic, a New York based real estate research and analytics firm, there are currently 3.1 million homes in the federal government&amp;#239;&amp;#191;&amp;#189;s REO inventory or headed toward it. &lt;/p&gt;
&lt;p&gt;This is a window of opportunity for you and me if I have ever seen one! It is my opinion, and the opinion of Rick Sharga, Senior Vice President at RealtyTrac, that short sales will not be negatively affected by this foreclosure mess. Short sales have and remain the better option for the distressed seller and for the bank. But now, at least for a time, short sale are the better option, and may be the only option, for the buyer. &lt;/p&gt;
&lt;p&gt;It is not clear how long the moratorium will last or length of time needed for thorough investigations to be completed. Expert opinions range from three months to 12 months. It seems logical to believe the collective effort will be well underway by year&amp;#239;&amp;#191;&amp;#189;s end. We should not be concerned with the duration of &lt;/p&gt;
&lt;p&gt;the moratorium, because short sales will be strong regardless. My concern is with what may be uncovered during the investigation that requires further attention. Can of worms, anyone? &lt;/p&gt;
&lt;p&gt;In conclusion, this is not a "Get Out of Jail Free" card. Bank of America said, "We will stop foreclosure sales until our assessment has been satisfactorily completed." They did not say they would stop the process of due diligence and disclosure. Distressed sellers have bought some time, so to speak, but if they are not making mortgage payments, banks will preserve their assets to the best of their ability. &lt;/p&gt;

&lt;p&gt;Robyn Yates, V.P. of Marketing for Windermere Real Estate, announced today the company's charitable foundation has selected Henderson Allied community Advocates, dba HopeLink, to receive its entire 2009 endowment, to put toward its homelessness prevention efforts. The $25,000 donation will be made official at a check presentation ceremony to be held at the non-profit organization's headquarters in Henderson, on June 9, 2010.&lt;/p&gt;
&lt;p&gt;The 2009 endowment of $25,000 came from Windermere agents.&amp;nbsp;For every transaction a Windermere agent made in the Las Vegas valley, a fee was donated to the foundation.&amp;nbsp;Windermere agents care about the community they live in.&lt;/p&gt;
&lt;p&gt;Established in Henderson in 1991, HopeLink focuses on preventing homelessness for families in crisis. For more than 18 years, the organization has worked to stabilize families and transition them back to permanent housing, through such services as emergency shelter, food pantry, transportation assistance and more.&lt;/p&gt;
&lt;div&gt;The grant from the Windermere Foundation will allow HopeLink to provide payment for approximately 75 weeks of temporary shelter for individuals and families on the brink of homelessness, as well as transportation assistance for clients in shelter and some administrative costs.&lt;/div&gt;
&lt;div&gt;&lt;br /&gt;
&lt;/div&gt;
&lt;div&gt;"We are so thankful to be receiving these funds. HopeLink's emergency shelter program is really geared to assist those who cannot be served by other programs, homeless individuals being discharged with medical conditions from hospitals, families who cannot be accommodated in other shelters, families with adult disabled children, and others who just can't be served in a typical environment," said Daniele Dreitzer, executive director of HopeLink. "We are seeing more and more families with children who just can't keep their homes with the current economic situation. It can take several weeks, and sometimes longer to get families stabilized and into other programs. These funds will enable us to serve families that need additional assistance for a longer period of time, with an eye towards long term stability."&lt;/div&gt;
&lt;p&gt;For the first time ever, Windermere's three Southern Nevada offices voted to combine their annual donations to the Windermere Foundation, for the purpose of awarding it to a single charity. Windermere held a call for submissions throughout the month of April, and Hopelink was among dozens of local non-profit organizations that applied to receive the grant.&lt;/p&gt;
&lt;p&gt;"Being in real estate, we put families in homes everyday," said Yates. "Through our donations to the Windermere Foundation, we are able to provide housing for in-need families in all of our communities. It is our way of showing how blessed we feel as a company to be in such a position to give back."&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The mission of the Windermere Foundation is to support homeless and low-income families. Nationally, non-profit agencies receiving Windermere Foundation dollars have furnished emergency and transitional housing, have subsidized costs for services such as health care, employment counseling, placement and training, day care, scholarships and much more. Contributions from Windermere agents combined with contributions from Windermere employees and the public have allowed the Windermere Foundation to distribute over $2 million annually in recent years to non-profit agencies dedicated to helping homeless and low-income families.&lt;/p&gt;
&lt;p&gt;The check presentation ceremony will be held from 3:30 to 4:30 p.m. on June 9, 2010, at 178 Westminster Way in Henderson. Refreshments will be served, courtesy of Panera Bread.&lt;/p&gt;

&lt;div&gt;The HAFA guidelines apply to lenders who voluntarily participate in the HAMP (Home Affordable Modification Program). &amp;nbsp;The &lt;YGG:ENTITY id="t1" ref="#TNIh0HT73BGcQT93XWfsEA"&gt;Department of Housing and Urban Development&lt;/YGG:ENTITY&gt; says more than 100 servicers have signed up to participate in HAMP, covering more than 89 percent of mortgage debt outstanding in the country&lt;u&gt;.&lt;/u&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
To be eligible for HAFA, homeowners must first apply for a loan modification through the &lt;a href="http://makinghomeaffordable.gov/" target="_blank" rel="nofollow"&gt;Home Affordable Modification Program&lt;/a&gt;, or HAMP. Owners who do not qualify for a loan modification or miss payments during the initial loan modification period qualify for HAFA.&lt;br /&gt;
&lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;&lt;strong&gt;Property and Homeowner Requirements.&lt;/strong&gt;
&lt;div&gt;
&lt;ul&gt;
    &lt;li&gt;Property is principal residence.&lt;/li&gt;
    &lt;li&gt;Mortgage originated before Jan. 1, 2009.&lt;/li&gt;
    &lt;li&gt;Mortgage is owned or guaranteed by &lt;YGG:ENTITY id="t2" ref="#xE1c9hH23BGXl8h4XWfsEA"&gt;Fannie Mae&lt;/YGG:ENTITY&gt; or &lt;YGG:ENTITY id="t3" ref="#lt9c9hH23BGXl8h4XWfsEA"&gt;Freddie Mac&lt;/YGG:ENTITY&gt;.&lt;/li&gt;
    &lt;li&gt;Borrower is delinquent or default is foreseeable.&lt;/li&gt;
    &lt;li&gt;Homeowner demonstrates hardship.&lt;/li&gt;
    &lt;li&gt;Borrower's total monthly housing payment exceeds 31 percent of gross income.&lt;/li&gt;
    &lt;li&gt;Unpaid principal does not exceed $729,750. &lt;/li&gt;
&lt;/ul&gt;
&lt;p class="hide"&gt;&amp;nbsp;According to HAFA rules, lenders now must offer a short sale in writing to the borrower within 30 days if the borrower does not qualify for or complete a loan modification. Borrowers then must respond within 14 days to the lender's short sale agreement.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;When a purchase offer is made, borrowers must submit the sales contract to the lender within three days, along with the buyers' mortgage preapproval and the status of negotiations with other lien holders on the seller's property.&lt;/p&gt;
&lt;p&gt;Finally, lenders must approve or deny the contract within 10 days.&lt;/p&gt;
&lt;p&gt;HAFA rules also state that lenders must release borrowers from the obligation to repay the difference between the sales price and the loan amount. &lt;strong&gt;No deficiency judgments are allowed for a first or second loan. &lt;/strong&gt;
&lt;h2 style="font-size: 12pt"&gt;&lt;span style="font-size: 10pt"&gt;In the past, short sales were especially difficult for homeowners with more than one loan on their home, since the home sale typically repaid only the first mortgage. HAFA's financial incentives include a payment of up to $3,000 for second mortgage holders&lt;/span&gt;. &lt;/h2&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Other HAFA financial incentives include $1,000 to loan servicers to cover administrative fees, up to $1,000 for mortgage investors who agree to share short sale proceeds&amp;nbsp;with second lien holders and $1,500 to the homeowners for relocation.&lt;/p&gt;
&lt;p&gt;The moving expense allocation acts as an incentive for them to stay in the property until the short sale goes through.&amp;nbsp;&amp;nbsp;&lt;span class=" href_cetemp="  ?&gt;&lt;cite&gt;&lt;cite&gt;&lt;cite&gt;&lt;cite&gt;&lt;/p&gt;

&lt;div&gt;&lt;br /&gt;
&lt;/div&gt;
&lt;div&gt;In early 2009 Short Sales averaged 7 to 8 percent of the total home closings. &amp;nbsp;By end of year that percentage had increased to nearly 25% of the total market of closings.&lt;/div&gt;
&lt;div&gt;&lt;br /&gt;
&lt;/div&gt;
&lt;div&gt;There has been a dramatic decrease in foreclosure activity in Las Vegas. &amp;nbsp;With the Federal Treasury putting pressure on Banks to either offer loan modifications or approve short sales, banks are foreclosing on fewer properties. &amp;nbsp;The Treasury Department is offering incentives on short sales by providing a $2,500 subsidy, $1,000 to the servicer and $1,500 to the seller for moving expenses. &amp;nbsp;In addition investors can get $1,000 by allowing subordinate lenders to get $3,000 in proceeds from the sale. &amp;nbsp;The program is effective April 5th but servicers can implement it earlier.&lt;/div&gt;
&lt;div&gt;&lt;br /&gt;
&lt;/div&gt;
&lt;div&gt;It is costly for lenders to go through the legal process of foreclosing. &amp;nbsp; Short Sales are so much better for neighborhoods. &amp;nbsp;Sellers selling their home on a short sale are generally still living in and caring for the home during the marketing and closing process. &amp;nbsp;This enhances the neighborhood because that Short Sale is one less foreclosure in the community.&lt;/div&gt;
&lt;div&gt;&lt;br /&gt;
&lt;/div&gt;
&lt;div&gt;Banks have really gotten organized in the past year to more effectively process and handle these Short Sales. &amp;nbsp;Many Banks have pulled Asset Managers from their Foreclosure departments and moved them to their Loss Mitigation (Short Sale) departments as Negotiators. &amp;nbsp;In addition Banks have moved the entire process from a pen and paper system to the same on line transaction systems that they are using to process their Foreclosures.&amp;nbsp;&lt;/div&gt;
&lt;div&gt;&lt;br /&gt;
&lt;/div&gt;
&lt;div&gt;In general a Short Sale is a more acceptable solution to most lenders than foreclosure. &amp;nbsp; Working with the bank to find a solution through Short Sale rather than walking away from the property demonstrates &amp;nbsp;higher level of cooperation.&lt;/div&gt;

&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family: Arial"&gt;President Obama today enacted two measures that provide incentives for lenders and loan servicers to make troubled mortgages more affordable. The legislation also streamlines Hope for Homeowners, a government program to refinance &amp;#239;&amp;#191;&amp;#189;underwater&amp;#239;&amp;#191;&amp;#189; loans that so far has helped few distressed borrowers.&amp;nbsp; Obama said the bills also require banks to honor existing leases on foreclosed properties, and provide $2.2 billion to help homeless families. In addition, the measures give federal investigators more tools to crack down on mortgage and commodity fraud.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span style="font-family: Arial"&gt;&amp;#239;&amp;#191;&amp;#189;I believe we&amp;#239;&amp;#191;&amp;#189;re moving in the right direction, but I want to remind everybody that it took many years and many failures to get us here, and it&amp;#239;&amp;#191;&amp;#189;s going to take some time to get us out,&amp;#239;&amp;#191;&amp;#189; Obama said. &amp;#239;&amp;#191;&amp;#189;The stock market will rise and fall. The job market has taken a beating and won&amp;#239;&amp;#191;&amp;#189;t be back immediately. The housing market still has a long way to go. &lt;p align="justify"&gt;&lt;span style="font-family: Arial"&gt;$8,000 Tax Credit May Be Used For Real Estate Down Payment &lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;&lt;span style="font-family: Arial"&gt;The good news the National Association of Realtors was clamoring for, came in the form of an announcement from Shaun Donovan of the U.S. Department of Housing and Urban Development (HUD). The &lt;a title="http://www.realtor.org/press_room/news_releases/2009/05/re_summit?lid=ronav0019" href="http://www.realtor.org/press_room/news_releases/2009/05/re_summit?lid=ronav0019"&gt;association's website&lt;/a&gt; reports that the FHA has given the green light to lenders for a change in the real estate down payment rules. &lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;&lt;span style="font-family: Arial"&gt;The National Association of Realtors states that the $8,000 tax credit that home buyers would normally be able to apply for during their tax preparation may now actually be applied toward the down payment of the real estate purchase. A specially designed loan vehicle "pays forward" the tax credit and thus the real estate buyer borrows the funds for the down payment. &lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;&lt;span style="font-family: Arial"&gt;In the past, the use of borrowed funds for a real estate transaction was considered an unacceptable practice. &lt;p align="justify"&gt;&lt;span style="font-family: Arial"&gt;The US News &lt;a title="http://www.usnews.com/blogs/the-home-front/2009/03/30/the-first-time-home-buyer-tax-credit-and-your-down-payment.html" href="http://www.usnews.com/blogs/the-home-front/2009/03/30/the-first-time-home-buyer-tax-credit-and-your-down-payment.html"&gt;Home Front Blog&lt;/a&gt; reported that already in January of this year, the state of Missouri was allowing the first time homebuyer tax credit to be turned into a down payment on a piece of real estate. The Missouri Housing Development Commission (MHDC) discovered a way of writing a second loan of up to 6% of the home purchase price, which would then later on be paid off with the first time homebuyer tax credit that is valued at 10% of the purchase price. &lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;&lt;span style="font-family: Arial"&gt;Consumers who repay the down payment loan will not be charged interest but instead only a processing fee. Inventory levels were down 22.2% compared to the same week of the prior year. &lt;/span&gt;&lt;/p&gt;

Homes that were listed and sold in less than 30 days sold for 101% of the listed price. Forty-six percent of the properties listed are selling for 101% of list price and closing in 30 days or less. This is an indicator that the majority of homes are priced at fair market value. &lt;/span&gt;&lt;/p&gt;

First-time homebuyers are realizing their dream of homeownership. Investors are taking advantage of the low prices and placing cash offers on properties that they hope will turn a profit. Short Sales (loans on properties that are higher than the current market value) are getting bank approvals faster and closing escrow.&lt;/span&gt;
